The Advocate for Dhr is present, but not filed hazira. The Advocate for Jdr is absent, but files memo and Xerox copy of certified true copy of order dtd.31.08.2018 passed by Hon’ble State C.D.R Commission, Odisha, Cuttack in F.A No.89 of 2014. The ordering portion is mentioned as follows:- “After going through the decisions of the Apex Court and observations made in the instant case we are of considered opinion that learned District Forum has gone wrong in passing the order.

                                         In the result, appeal is allowed setting aside the order dated 10.12.2013 passed by learned District Forum, Balasore in C.D Case No.47 of 2012.

                                         Records received from the District Forum be sent back forthwith.”

                                         The order dtd.10.12.2013 passed by this Forum in C.D.C No.47/ 2012 has been set-aside. So, the present Misc. case has no locus standi. Hence, this Misc. case is closed/ dropped accordingly.
