FINAL ORDER / JUDGEMENT

The Complainant files hazira through Advocate.

No step is taken by the O.P. who is found absent on repeated call nor any written version filed.

In view of the conditional order dated: 05/04/2024 the case is taken up for Ex-parte hearing.

The Complainant’s case is that he booked online an order for purchase of a Smart Wrist Watch i.e. Fastrack Revoltt FS1 Pro/World’s First 1.96 Super AMOLED/Highest Resolution/BT Calling Smartwatch for Rs.2,459/- with O.P. on 04/11/2023 but he received the delivery product of Smart Wrist Watch as “Fastrack Revoltt FS1” which is different from the booking product. Thereafter the complainant informed the matter to the O.P. Authority via e-mail either for return of the wrong product and deliver the booked product or return the price thereof. But the O.P. did not respond to the prayer of the Complainant. Hence this case.

Though Notice has been served upon the O.P. as per track report but the O.P. did not prefer to contest the case by filing any written version. On perusal of all the materials on record and the petition of complaint and after hearing the Ld. Advocate for the Complainant the Commission finds that the prima facie case of the Complainant is proved in this case.

Hence it is ordered……

That the case be and the same is allowed Ex-parte against the O.P. but without cost.

O.P. is directed to supply the real booked product as mentioned above to the Complainant within a fortnight from this date failing which O.P. is directed to return the price thereof i.e.  Rs.2,459/- to the Complainant within a fortnight thereafter with litigation cost of Rs.2,000/- and to take back the delivery of the wrong product on payment of the decretal amount within the stipulated period.

Both parties be supplied copy of this order free of cost.
