This complaint coming on 17-03-2015 before us for hearing in the presence of Sri S.M. Shaida, advocate for the complainant and opposite parties 1 to 3 called absent and having stood over for consideration till this day and this Forum made the following:
ORDER

The brief averments of the complaint are as follows:
The complainant is having vacant ste in Vengalrao Nagar, Nellore. He wanted to build house and submitted plan alongwith application No.2013-TP-0381, on 22-03-2013. The complainant paid fee also for approval. However, the opposite parties have not approved the plan and send orders of approval. The same is deficiency of service and illegal. As such, the complainant could not proceed with the construction and suffered loss. The complainant got issued a legal notice also. Hence, the complaint for release of the approved plan, damages and costs.
2. The opposite parties did not contest the matter after receiving the notice.
3. Now the point for consideration is “whether the opposite parties committed a deficiency of service?”
4. The complainant filed his affidavit and marked Exs.A1 to A6.
5. POINT: Ex.A1 is the document in favour of the complainant. The identity of the property mentioned in Ex.A1 tallies with the description of the property given in para-3 of the complaint. Ex.A2 is the copy of the application for approval of plan. Ex.A3 is the receipts for the payment of the plan approval. Ex.A4 is the copy of the legal notice. Ex.A5 is the postal acknowledgements. Ex.A6 is the receipt for payment through Rajiv Citizen Services, dated 05-06-2014.
6. The alleged deficiency of service is, not accepting or refusing the plan submitted for approval by the complainant to the opposite parties. The law empowers the opposite parties to approve the plan or reject the same. Section-213 of the A.P. Municipalities Act ( a xerox copy of the section is supplied by the complainant), enables the opposite parties to approve or refuse permission within sixty days. The period of sixty days count from the date of approval of the site. The complainant paid the fee for site approval on 22-03-2013 under Ex.A2. The site has to be approved within sixty days by the opposite party. Ex.A2 shows that the matter was pending even on 11-04-2013. Under 212 of the A.P.Municipalities Act, the opposite parties have to convey the approval or disapproval in writing. It is not the case of the opposite parties that they refused the applications of the complainant. Section-214 of the same lays down, that in the absence of approval or refusal by the opposite parties, it shall be deemed that the approval was given and that the applicant may proceed with the execution, as per the provisions of the law. The opposite parties have not intimated approval or refusal within the time prescribed by law. The same is illegal. An illegal act amounts to deficiency of service. The complainant established deficiency of service. The opposite parties are therefore ordered to release the orders of approving the plan within ten days by this order, failing which, the complainant shall proceed with the execution of the work as per other provisions of law. Since, the complainant suffered mental agony, a compensation of Rs.10,000/- and costs of Rs.2,000/- are granted. The point is held accordingly.

In the result, the complaint is allowed ordering the opposite parties to send the orders of approval of the plan submitted by the complainant within 10 days, failing which, the complainant can proceed with the execution of work as per other provisions of law. The opposite parties shall also pay a compensation of Rs.10,000/- (Rupees ten thousand only) and costs of Rs.2,000/- (Rupees two thousand only).
