            Today is fixed for final order. The case was heard on 13.05.2022 on behalf of the O.P as the complainant was absent.

            The complanants’ case was that he took gold loan of Rs. 39,000/- from the O.P. No.1 and the complainants totally paid the outstanding interest on 30.04.201. The O.P. No.1 told that the gold was already sold and accordingly the complainant filed this case for returning back the mortgaged gold to the complainants and for compensation.

            The O.P filed written version stating that the complainants had taken loan to the extent of Rs. 13,000/- and it was required to be repaid within 12 months on 30.12.2014. The O.Ps having no other alternative to recover its dues the O.Ps shall auction the gold ornaments for recovery of dues. Hence the O.P prayed for dismissal of the case.

            The Ld. Advocate for the O.Ps submitted that the complainant failed to appear on several dates and failed to take steps and accordingly the case should be dismissed.

            None appeared for the complainant to submit regarding the merit of the case.

It is,                  Ordered

            that the case is dismissed for default in absence of the complainant.

Let plain copy of this order be given to the parties free of cost.
