The petition filed by O.Ps. praying for vacating the order for hearing the case exparte is taken up. Complt files hazira through Ld. Advocate.

                Perused the petition and other materials on record. Heard both sides. The Complt. raised  no-objection.

                In the said petition O.P.No.1&2  has prayed for vacating the order for hearing the case exparte.

                From the record it is found that the O.P. appeared before the Commission in time, but he failed to submit W.V. within the statutory period.  As such, the case was fixed for hearing the case exparte. The O.P. No.1&2 have filed W.V. today, Copy Served, let it be kept with the record which shows his intention to contest the case. So, he must get an opportunity to contest the case. However, he must pay cost as penalty for causing delay. The petition accordingly considered and allowed.

                                               Hence It Is,

Ordered

                That the Miscellaneous Application No.MA/08 /2023 be and the same is allowed on contest with a cost of Rs.500/- to be deposited in the Consumer Legal Aid Fund, Paschim Medinipur. The order for hearing the case exparte is hereby vacated. The W.V. filed by O.P. will be accepted only after payment of cost.

              The case is thus disposed of.
