                                                          J u d g e m e n t.

          The  present dispute arises out of the complaint petition filed by the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for non refund the amount a sum of Rs.8,600/- which the complainant could not get the money from the A.T.M.    The brief facts are summarized here under.

          On being noticed the  O.P. appeared through their learned counsel and refuted the allegation made against the O.Ps.  The O.Ps taking other grounds in the written version   sought to dismiss the complaint as it is not maintainable  under the C.P. Act, 1986.   Hence the O.ps prays the forum to dismiss the case against  them  to meet the ends of justice.

          Heard from the parties. Perused the record filed by the parties.

                                                          Finding.

          On perusal of the written version filed by the O.P. it is revealed that  the O.Ps though have limited role in the transaction operated  by the complainant  through the ATM of   other bank  did not keep silent on the matter. On the oral intimation the O.ps have moved the National  Financial system Ltd., Mumbai which is authority to examine and settle the same.  Further it is observed  from the written version  the complainant has received the said amount a sum of Rs.8,600/- which was credited in the S.B. account of the complainant  maintained  in the IOB, Rayagada on Dt. 7.7.2017 (Copies of the  account statement is enclosed herewith  which is marked as Annexure-I) for perusal of the forum.

          During the course of hearing the learned counsel  for the complainant agreed to close the  above case as the amount has been credited in the  complainants S.B. account  of the complainant.

          This  forum  observed there is no deficiency in service on the part of the O.Ps.

          To meet the ends of justice  the following order is passed.

                                                ORDER.

          In resultant  the complaint petition is  disposed off. There is no order as to cost.
