J U D G M E N T
One Sri Subir Das filed this complaint U/S 12 of the Consumer Protection Act alleging deficiency of service by Indian Post. He filed the case against the Chief Post Master General, Director of Postal Services. Petitioner's case was that he purchased KVP for Rs.10,000/- at Arunachal Pradesh. He wanted to transfer it to Agartala and get the amount. Accordingly on his transfer petition the certificate was transferred to Agartala and surrender value was given to it. There was 81 days delay. So, he prayed for compensation of Rs.95,000/-.
O.P. appeared, filed W/S and stated that time taken for checking the original certificate at Arunachal Pradesh. The certificate was taken at Jairampur Sub Post Office. So, his request was sent there. Thereafter in due course the certificate was transferred. 80 days time was taken.
3. Petitioner did not appear to give any evidence.
4. O.P. appeared filed the statement on affidavit. We have gone through the evidence given by the O.P. It is found that due step was taken in time for transfer of the certificate from Jairampur, Arunachal Pradesh to Agartala. The certificate was not purchased from any Sub post Office under the Agartala Head Post Office. As per citizen charter the amount is to be disbursed within 30 days if the post office is situated under the Head Post Office. But in this case certificate was purchased under Itanagar, Head Post Office not at Agartala. So, its transferred was not possible within 30 days. It took 81 days. It is not a deficiency of service. Therefore, the petitioner is not entitled to get any compensation. Petitioner did not give any evidence to support any deficiency of service of O.P. We therefore, of the considered view that petitioner is not entitled to get any compensation in this case.
The case has no merit and stands dismissed. Parties are to bear their own cost.
