D/hr files hazira.

Today is fixed for E/R of W/A.

On behalf of I/C, Kotwali P.S., Cooch Behar Mr. Joy Gopal Majumdar, Arresting Officer, Rank ASI, place of posting Kotwali P.S, Cooch Behar produce an arrest cum inspection memo and also produce the J/dr, Jotish Sutradhar.

Both the J/dr and a plain copy of W/A issued by this Forum is produced. The J/dr is taken into custody.

The D/hr, Bidyut Kr. Dutta by filing a petition stated that the dispute has already been settled amicably. Both the D/hr and J/dr by filing a joint verified petition stated that as the dispute is already settled, the D/hr is not interested to proceed with the case and prayed for an order for disposal of the case. The Complainant files a Money Receipt of Rs.1,00,000/-.

Heard both the parties and it appears that the D/hr already received Rs.1,00,000/- from the J/dr with full satisfaction and there is no dispute at all.

Considering the above facts and circumstances, we are inclined to hold that we have no impediment to dispose off  the execution case.

The J/dr be released accordingly.

Accordingly, the prayer of the parties is considered and allowed.

Hence,

           Ordered,

                         That, the execution Case No.CC/Ex/6/2014 be and the same is disposed off with full satisfaction and dropped accordingly.

Let plain copy of this order be made available and be supplied free of cost, to the concerned party.
