The complainant is a wife of deceased Hanumanthappa Obalappanavar, who opened a SB account on 27-03-2014 in SBI, Koppal, for which reason a Group Personal Accident policy was issued, which is applicable to SBI savings bank account holders on a premium of Rs.100/-.  The policy period was 27-03-2014 to 26-03-2015.

 

2.  As per the averments in para – 3 of the complaint, the complainant’s husband died on 26-09-2014 due to paralysis in the home of the complainant itself.  A certificate from Dr.V.B.Inamdar dated: 23-09-2014 discloses that complainant’s husband was suffering from paralysis and approached said doctor as outpatient basis. 

 

3.  After the claim was made, the SBI General Insurance Company sought for the following details in letter dated 11th Feb 2015 and 26th Feb 2015 vide Annexure 17 & 18.

 

  1. Copy of cause of Death Certificate attested by issuing authorities.
  2. Copy of Final Police Report attested by issuing authorities.
  3. Copy of FIR/MLC Copy/Spot panchanama/Inquest Panchanama attested by issuing authorities.
  4. Copy of Post Mortem Report attested by issuing authorities.

 

 

4. The complainant has not furnished the above documents for obvious reason that the same were not available because the insured died due to paralysis and not due to accident.

 

5. The policy in question at Annexure – 10 clearly discloses that the sum assured is payable only in case of death due to personal accident.  This is not a case where the complainant’s husband died due to an accident.  Hence there is no liability exists.  Hence, the complaint dismissed at the stage of admission.
