Bijali Sarkar Das, W/O- Late Ram Chandra Das filed a consumer case on 20 Jun 2013 against The chief Manager, U.T.I. Mutual Fund, Malda Branch Office in the Dakshin Dinajpur Consumer Court. The case no is CC/17/2013 and the judgment uploaded on 16 Feb 2022.
The complainant a holder of old master plus 1991 folio no-756961, certificate no 03929832, distinctive no 422570201-422570300 having face value Rs. 1,000/- bearing new folio no 50244964675, applied for redemption on maturity and complied all formalities. She also sent all necessary papers to UTI Malda Branch through Night-ingle Exp vide no 45135 on 19.09.2012 which were received by the branch on 21.09.2012, But no response was there. Reminder vide no 46782 dt. 06.112012 also remained unattended.
Hence the case.
The Op no-1 contested the case by submitting written version contending enter alia that the claim could not be processed because the name of the holder mismatched between old certificate and photo identity proof. Op no-1 is always ready and willing to settle the matter as soon as the complainant submits required documents specially the correct photo identity proof.
Admittedly the complainant is holder of 100 units of UTI of old master plus 1991 as detailed above. She prayed for redemption by sending documents mentioned above. From the documents captioned counter rejection filed by Op no-1 it appears that on receipt of prayer for redemption the Op no-1 by its letter dt.29.09.2012 requested the complainant to submit the photo identity proof in the name of Bijoli Sarker Das on the ground that her name mismatched between old certificate and photo identity proof. She was also informed by that letter that further request could be submitted and solicited her co-operation for timely processing of her request. Therefore, it is clear why the earlier request of the complainant could not be entertained timely. Such processing may be easily done provide the complainant submits, along with other necessary documents, her photo identity proof in the name Bijoli Sarker Das as it appears in her certificate under consideration.
Therefore, the grievance of the complainant can be easily addressed provided she complies with the requisition of the Op no-1 as informed by its letter dated 29.09.2012.

O R D E R E D
That the application U/s 12 CP Act dated 18.02.2013 is allowed on contest. The Op no-1 is directed to redeem the master plus 1991 units having new folio no 50244964675 and pay the complainant the redemption value by an account payee cheque within 15 days from the date the complainant submits her photo identity proof in the name of the Bijoli Sarker Das together with other necessary documents and application if any.
