Order No. 28 dated 28.9.15 passed in C.C no.74 of 2013 - This Forum has passed an Award of Rs. 16,253/- against the O.P, S.B.I, Jalpaiguri. Also cost of Rs.1,000/- was allowed. Further the complainant has been awarded Rs.1,000/- in the head of Unfair Trade Practice by the O.P, S.B.I, Jalpaiguri and in the head of Compensation for mental agony and pain suffered by the complainant for the act of O.P, S.B.I.
Against this Award the Chief Manager, State Bank of India, Jalpaiguri went in Appeal before the State Consumer Disputes Redressal Commission, West Bengal , Kolkata. It has been ordered by the Ld. Appellate Commission that Reliance Life Insurance Company Ltd. is a party to the case and to dispose of the case on merit giving reasoned order after giving the opportunity to the parties for placing their submission. Also it has been observed that the O.P State Bank of India has not transferred interest in making payment but it serves interest of the complainant and paid the premium amount passed on an E.C.S mandate and that to none other than to Reliance Life Insurance Company Ltd. Therefore, the Appeal has been allowed in part.
In terms of above order passed in Appeal E.A case no. 3/2016 u/s. 25 of the Consumer Protection Act has become infructuous as awarded by the Hon’ble Appellate Court.
In view of the Appeal, case has been restored to its file under original number with direction to implead Reliance Life Insurance Company Ltd as necessary party to the case. Execution is thereby dismissed.
Order No. 22 dated 14.1.2019 posting the Execution application on 13.2.2019 is shifted back to this date. Order of this day dismissing the Execution Appeal in terms of Award passed by the Appellate Court is passed.
