Final Order / Judgement | As per joint compromise petition filed by both the parties and Succession Certificate as well as written note of argument filed by the complainant, it is revealed that OP No. 2 to 5 have no objection if 1/5th share out of the P.F , gratuity and leave encashment amount owing to the deceased Bhola Guchait. This Commission finds that the deceased was not married and the complainant as well as OP No. 2 to 5 are the only successors to his property and OP No. 1 (Bank) is the custodian of the amount of the deceased Bhola Guchait. In view of the compromise between these parties, this Commission orders that OP No. 1 shall release of Rs. 8,77,874/- (Rupees eight lakh seventy seven thousand eight hundred seventy four) only with accrued interest if any to the Indian Bank account of the complainant bearing No.7060095083 held with Bhadrak Branch and rest 4/5th of the amount with accrued interest if any be released in favour of OP No. 2, 3, 4 & 5 forthwith . In view of the final disposal the earlier order of this Commission dt. 27.06.2023 stands infructuous. Intimate to OP No. 1 & 6 to carry out the order. | |
