Complainant files hazira through his Ld. Advocate. The case is taken up for admission hearing. Hd. ld. Lawyer for the complainant. Perused the petition of complaint and the documents filed considered.
The complainant contended that he took loan of Rs.5 lakh from the Op-Bank on 08/07/02 against deposit of potato with the Op. no.2. First renewal of loan was on 13/07/13 and the second renewal of loan was on 13/03/2004. Thereafter, the complainant could not repay the loan amount due to fall of price of Potato.
So, the dispute is with regard to loan in which matter this forum has nothing to do. Moreover, the potatoes kept with the Op. no.2 were allegedly damaged in 2005. i.e. about 8 years back. The complainant should have approached this forum within 2 years of such damage. The case is clearly barred by limitation. Further, the complainant moved the banking ombudsman and he decided the matter. After taking recourse to the banking ombudsman, the complainant cannot move this forum.
So, from all angle, it appears that the case is not fit for admission.
Hence, the case is not admitted.
