.                                               JUDGMENT

The  curx of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for  non refund of Rs.11,596/- which was deducted from the S.B.account  of the complainant towards availing loan  for which  the complainant  sought for redressal of the grievances raised by the complainant.

On being noticed the O.Ps appeared through their learned counsel and filed written version refuting allegation made against them.  The O.Ps taking one and another pleas in the written version   sought to dismiss the complaint as it is not maintainable  under the C.P. Act, 1986. The facts which are not specifically admitted may be treated  as denial of the O.Ps. Hence the O.Ps  prays the forum to dismiss the case against  them  to meet the ends of justice.

Heard from the parties. Perused the document filed by the parties.

During the course of hearing the  learned counsel for the O.P filed  copies  of   Bank statement showing  the amount a sum of  Rs.11,596/-  has already been  credited  in the S.B. account of the complainant  (copies of the same is in the file marked as Annexure-I.).

       Besides  the  learned   counsel for the complainant  is present before the forum and has submitted   a memo to withdraw the case since the O.P.  has already credited  the outstanding amount in the S.B. account of the complainant  and he has no more claim against the O.Ps in connection with the aforesaid case.

                We perused the memo and the memo is allowed. The interim order passed on Dt.13.3.2018 stands vacated.

                Accordingly the case is closed  as not pressed by the  complainant. Parties are left  to bear their own cost.
