Final Order / Judgement

None is present on behalf of the complainant.

This complaint was filed by the complainant before this Ld. Commission on 25.10.2021. Date was given for admission hearing on 08.11.2021. On 08.11.2021 none was present on behalf of the complainant and the Ld. Bench was pleased to fix the admission hearing on 12.11.2021. On 12.11.2021 complainant remained absent without taking any step. As the statutory period was not over for admission hearing since its filing the Ld. Bench was pleased to fix the admission hearing on 16.11.2021. On 16.11.2021 the complainant remained absent as usual  without taking any step. In the interest of Natural Justice the Ld. Bench kept this record as pass-over till completion of the Ejlas on 16.11.2021. After completion of Ejlas this case was further called, but none was found present on behalf of the complainant.

In view of the sub-Section 2 of the Section 36 of the Consumer Protection Act, 2019 it is enumerated therein that ‘provided further that the admissibility of the compliant shall ordinarily be decided within 21 days from date on which the complaint was filed’.

In the instant complaint more than 21 days has already been elapsed since the date of filing of this complaint. For this reason we are of the view not to provide any further scope to the complainant for admission hearing. Accordingly the compliant is dismissed.

 

Going by the foregoing discussion hence it is ordered that the Consumer Complaint no. CC/336/2021 is hereby dismissed without being admitted. There is no order as to cost.

However the complainant is at liberty to approach before the appropriate Civil Court for redressal of his grievance. If not barred otherwise.

The complainant is also at liberty to get return the copy of the complaint and the documents from the appropriate authority of this Commission as the complaint is not admitted. In this respect the complainant is further directed to submit a separate application praying for return of the abovementioned documents. The appropriate authority of this Commission is hereby directed to take necessary step upon receipt of the application from the complainant so that the complainant can get return of the aforementioned without any further delay.

Let plain copy be given to the parties free of cost as per CPR.
