JUDGEMENT

      

       The  crux of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps    for  non release  of Tractor  finance vehicle bearing Regd. No. OD-18-D-4398 which was arbitrary seized    for which  the complainant  sought for redressal of the grievances raised by the complainant.

       The complainant has  filed a petition U/S- 12 of the C.P. act along with  interim petition U/S- 13-3-B of the  C.P. Act, 1986 before the forum.

After  hearing from the learned counsel for the complainant this forum on Dt. 01.10. 2019  has  passed interim order exparte against the O.Ps directing the O.Ps   to release the Tractor  bearing Regd. No. OD-18D- 4398    and handed over  the above  Tractor to the   complainant  after receipt of  2(two) Nos. of E.M.Is from the complainant. 

Aggrieved the above exparte  interim order Dt. 01.10. 2019  the O.Ps have  preferred  revision before the Hon’ble State C.D.R.Commission, Cuttack vide R.P. No. 106 of 2019.

        The  Hon’ble  State  C.D.R. Commission  after hearing from the  parties   on Dt .09.12.2019  has  passed  order  i.e.  the Revision petition   vide No. 106 of 2019  is allowed and the  impugned  exparte  Interim  order Dt.1.10.2019 amounts to final order   passed  by this forum  is set aside.

        Keeping in view  of the above  order passed by  the  Hon’ble State C.D.R.Commission,  Cuttack  the present C.C. case No. 91 of 2019  pending before  this forum accordingly  closed. Parties are left to bear their own cost.

Serve the copies of above order to the parties free of cost.
