Order No. 8  dt.  21/10/2016

       The case of the complainant in brief is that the Complainant’s  mother died on 14.09.2006 and the amount of Rs.1,35.331/- was kept in the Bank. The complainant  being the only daughter claimed  the amount from the Bank. The complainant filed a succession case being no.325/2011 and the other case was allowed. In spite of getting an order from the Court to receive the amount of Rs,1,35,331/- plus  interest accrued thereon but the Bank in spite of  nomination and the claim made by the complainant did not release the fund in favour of the complainant.

            On perusal of the document we find that the Bank was informed for releasing the amount but no action was taken from the OP. The complainant having no other alternative to file this case praying for direction upon the Bank to release the fund as well as for compensation for harassment and mental agony. The complainant has also prayed for litigation cost.

            Considering the materials on record we hold that there was  deficiency in service on the part of the Bank OP and the complainant will be entitled to get the compensation from the OP for causing harassment and also there was deficiency in service on the part of the OP Bank.

            Hence, ordered

            That the CC-225 of 2015 is allowed ex parte. the OP is directed to release the fund of Rs.1,35,331/- + interest accrued thereon and also to pay compensation of Rs.30,000/- and litigation cost of Rs.5,000/- within 30 days from this day failing which the complainant will be entitled to get interest @ 9% p.a. till the realization of the said amount.

               Supply certified copy of this order to the parties free of cost.
