Final Order / Judgement

Order No. 4                Dated: 09.12.2022

Today is fixed for admission hearing.

Neither the complainant nor his Ld. Advocate on Record nor his Representative is present on repeated calls and no steps is taken for the complainant.

On scrutiny it appears that the Consumer Complaint was registered on 15.09.2022 fixing 13.10.2022 for admission hearing and on 13.10.2022 none was present for the complainant and no steps was taken. The next date of the matter was fixed on 14.11.2022 for appearance of the complainant and admission hearing but on that date Ld. Advocate for the complainant prayed for time for hearing.

None was found present for the complainant to represent the case today till 01.00 p.m.

As per Section 36 of the C.P. Act, 2019, the matter of admission should be decided within 21 days, but the complainant filed an application U/S 34 (2)(b) of the C.P. Act, 2019 on 14.11.2022 and that 21 days has already been elapsed for taking steps.

In view of the above, the Consumer Complaint is rejected being not admitted.

MA/692/2022 accordingly stands dismissed.
