Brief facts of the case:-

Case in hand is the allegation of  deficiency in service and unfair trade practice by the O.Ps  for  non payment of maturity value   of  04(Four) numbers of  Bonds/Certificates i.e. Sahara Q shop with accrued interest  which  the complainant sought  redressal.

The O.Ps not appeared though notices has been duly served resultant made exparte.

.A preliminary study of the nature of the complaint  reveals that it is a case of breach of contract. As per the contract between the parties, the O.Ps in the instant case promised to return the deposited amount to the  complainant   with a specified  rate of interest when their  Certificate/Bond matured.  When they have failed to fulfil their obligation it tends  to breach of contract.  Therefore, breach of contract itself may result in deficiency in service. The Consumer Protection Act, 2019 provides for a special remedy for such  grievance and for awarding compensation to the  aggrieved party.

It  is observed  the O.Ps had issued  04(four) Nos. of certificates  in favour of the complainant in different  dates (Copies of the certificates are available  in the file which is marked as Annexure-1 to  04)  with assurance  to  pay back  his amount with up-to-date interest.  After maturity date the complainant  submitted  the  required documents to the O.Ps  for payment of  maturity amount. But till now the  O.Ps have  not  paid the  maturity amount  to the complainant.

In the given  facts and circumstances  of the case  we deem that the  holding   of deposited  amount by the  Opposite party for such long time  amounted to deficiency in service as  defined U/S 2(11) of C.P. Act, 2019.

“Deficiency” means any fault, imperfection  shortcoming or inadequacy in the quality, nature and manner of performance which is required  to be  maintained by  or under any law  for the time being in force or has been  undertaken to be performed  by a  person a pursuance of a  contract or  otherwise in relation to any service  and includes-

(i)any act of negligence or omission or commission by such person which  causes loss or injury to the consumer, and

(ii)deliberate withholding of relevant information by such  person to the consumer.

The Commission  hold that  the action of withholding of   payment abstain  from  payment by the  Opposite parties is not genuine. It is arbitrary and oppressive and is   a gross deficiency  in service  on the part of the  O.Ps and because of this breach the complainant suffered economic damages. Hence the  complainant deserves  to be  compensated.  In our  view  the interest of justice  would met  if this Consumer award accrued  interest  from the date  of maturity till its realization. 

In view of the  above findings  relating to the  case in  hand  we allow  the above complaint in part.

                                                ORDER.

The O.Ps are directed to pay the  maturity value and other benefits   of the  04(four) No.  Certificates/Bonds  bearing  Certificate No. (1)562010909 (2)562009037313 (3)562009037653  (4)562010910040  along with  interest @  Rs. 15% per annum from the date of respective maturity till  realization.

The entire directions shall be carried out with in 50 days from the  date of receipt   of this order.   Parties are left to bear their own cost.

.Miscellaneous  order if any  delivered by this  commission  relating to this case  stands vacated.
