The crux of the case is on deficiency of service of the Opposite parties (O.Ps) alleged by the complainant for non-refund of deposited premium amount bearing policy No.12303307.
Perused the record. The O.P. 1 & 3 have appeared and filed their version. The O.P. No.2 not appeared through notices has been duly served and made exparte.
Heard to the complainant and O.P. No.1 & 3. Verified the letter Dated.30.3.2020 of the complainant addressed to the O.P.(Max life insurance), cheque bearing No. 797231 Dt.13.09.2021 issued by the O.P. in favour of the complainant. It reveals that case has already been amicably settled and this commission has at present to pass an order to revalidate the cheque as the validation of the cheque has already been expired.
O R D E R.
In the result this commission is directed to the O.Ps 1 & 3 (Max life insurance) to receive the original cheque No. 797231 Dt. 13.09.2021 from this District commission and to issue fresh cheque in favour of the complainant for the sum of Rs.8,047.60 or to credit the same amount in the account No.911010058168783 of Axis bank of the complainant within 15 days from the date of receipt of this order.
The office is directed to hand over the cheese to the O.Ps with due acknowledgement.
Parties are left to bear their own cost.
A copy of this Judgment be provided to all the parties free of cost as mandated by the Consumer Protection Act, 1986 / 2019 or they may download same from the confonet.nic.in to treat the same as if copy of order received from this Commission.
The judgment be uploaded forthwith on the website of the Commission for the perusal of the parties.
