Both the parties are present. Today is fixed for hearing. The case is taken up for hearing. Hd. both sides.
The present case has been filed by the complainant praying for declaring that the agricultural loan as taken by the complainant has been waived by the Government of India under the scheme and claiming compensation of Rs.50,000/- from the Op.-Bank for causing harassment. After hearing both the parties it appears to be an admitted position that the complainant took loan of Rs.99,000/- on 09/02/05 for agricultural purpose for purchase of a power tiller and till 22/12/2007 the complainant paid a total amount of Rs.30,500/- to the Op-Bank including interest. Thereafter by virtue of a scheme namely Agricultural debt waiver and debt relief scheme 2008, the loan disbursed to an agriculturist upto 31st March 2007 and remained overdue as on 31st December, 2007 and remaining unpaid until 29th February, 2008 shall be waived. Admittedly, under this scheme a total sum of Rs.26,588/- towards principal and interest was waived. The complainant in this case claimed that the entire amount of loan was waived but that was not the position. By the scheme the unpaid loan amount was waived for a specific period as noted above.

In the present case during hearing the parties have come to the consencious after perusal of the document of each other that after waiver of the overdue amount under the scheme of the Govt. of India as aforesaid, a sum of Rs.70,688/- remained due from the complainant to the Op-Bank as on 01/03/2008. The complainant appears to have misconstrued the scheme of the Govt. of India and thought that the entire loan taken by him has been waived which was not the proper perception. Therefore, we do not find that there was any latches or deficiency on the part of the Op-Bank and as such the present case is liable to be dismissed. Hence, the case is dismissed on contest. Before parting with the record, we would like to mention that Ld. Lawyer for the complainant prayed that the Op-Bank may be directed to issue statement of loan showing outstanding as because the complainant has not been served with that. The representative of the Op-Bank agreed to furnish statement if and when asked for by the complainant. Accordingly, it is expected that the Op-Bank shall furnish the statement to the complainant from time to time if and when asked for.
