ORDER

This complaint was filed for recovery of deposit made by complainant with opposite party with interest. The opposite party admitted the receipt of deposit but contended that the interest has been paid up to 31.03.2005. The parties filed documents and opposite party produced account books maintained by it during argument. The case was being adjourned for verification of account. In the meanwhile the opposite party filed memo on 20.05.2008 stating that an amount of Rs.1,80,000/- has been paid on 19.05.2008 to complainant in full settlement of the claim made in the complaint. The voucher shown to have executed by complainant is produced. The counsel for complainant took time to verify the execution of payment voucher by complainant. Today the learned counsel for complainant submitted he could not contact his party and further order may be passed. We perused the admitted signatures and signature found on the discharge voucher dated 19.05.2008. We are satisfied that this voucher has been executed by complainant. The secretary of complainant who is present before the Forum submitted that he was present at the time of settlement and payment of amount and at the time of execution of voucher by complainant. Hence we pass the following ORDER The complaint is dismissed. Parties to bear their own costs.
