Final Order / Judgement

Today is fixed for hearing.

After hearing the Ld. Advocate of the complainant and perusing the material placed before us we see that the grievance raised by the complainant is as against the hospital or Health Institute where the complainant’s mother was admitted on 27.07.2022. It is alleged by the complainant that his mother Sulekha Jana was admitted to hospital under mediclaim policy. But policy paper has not been filed and in the absence of policy paper the question as to the patient entitlement to cashless medical benefit cannot be decided. That apart the discharge certificate was also issued on 01.08.2022 in favour of the patient. The case of the complainant that the hospital authority has refused to release the patient for non-payment of a bill amounting to Rs more than 1, 00,000/- appears to be inconsistent with discharge certificate. Certainly the hospital is entitled to the treatment cost for providing treatment to the complainant’s mother. Apparently we do not find any fault on the part of the hospital. The materials on record are insufficient to indicate or establish unfair trade practice on the part of the OPs. Therefore, the case has no leg to stand upon at this stage.

Hence it is ordered that the case be and the same is dismissed on being not admitted.

Let a plain copy of this order be given to the parties free of cost as per CPR.
