ORDER

            The respondent had made Misc.Application No.62 of 2012 stating therein that the Chandigarh Housing Board is complying with the impugned order without prejudice to its right to file revision petition before the Hon’ble National Commission and SLP before the Hon’ble Supreme Court of India. It has been further stated that the Chandigarh Housing Board also reserves its right to recover the excessive amount paid to the allottees. The said submission made in the application is premature and will be considered if there is any order passed either by the Hon’ble National Commission or by the Hon’ble Apex Court. The bankers cheque of Rs.8500/- (No.793399 dated 28.3.2012 favouring Sh.Karanvir Singh drawn on State Bank of India) has been handed over to the counsel for applicant-complainant. Photocopy of cheque in question in token of receipt retained on record. The Misc.Application No.62 of 2012 of respondent stands disposed of accordingly.

            Counsel for applicant-complainant made statement that he received payment being satisfied but there should be no condition and withdrawn the petition. Such statement has been recorded on the application itself. In view of this, the application is dismissed as withdrawn.

            Certified copies of this order free of cost be supplied to the parties. Be tagged with the main file.
