On call the appellant is absent today though on 3-1-2022 the appellant Sri Utpal Goswami appeared in person in presence of Mr. N. Deka, learned counsel, appearing for the respondent APDCL.
On the last occasion a mention was made by Mr. Goswami that the matter was already compromised with the respondent APDCL and in support of the said contention of Mr. Goswami, he referred to the petition dated 2-7-2019 filed and put on record which consists of the following prayer.
Therefore, it is prayed that Hon’ble Court may be pleased to pass decree taking the compromised petition as a part of the decree in this case on the basis of the compromise arrived between the parties as mentioned herein above and/or to pass order(s) as the Hon’ble Court may deem fit and proper.
The said petition is also supported by a joint verification of the appellant himself and one Sri Robert Handique, representative of APDCL. The said statement of Mr. Goswami was verified by Mr. Deka who is present today and submits on behalf of the respondent APDCL that the matter has already been compromised in terms of joint petition dated 2-7-2019.
In view of the submission of Mr. Deka and upon consideration, the materials on record, referred here-in-above, we close this appeal and the same is disposed of on compromised.
This accordingly allow the prayer referred here-in-above and the impugned judgment and order in the appeal merges with the compromised decree.
