COMMON ORDER

          I. Though the complainants are different, their grievances, allegations and the facts pleaded are same except the details of the deposits by the respective complainants. In both cases the O.Ps. are same. Hence, for convenience both cases are disposed of by the common order.

          II. Since there are 5 cases and complainants are having same address and particulars of the deposits being different, for brevity and also for clarity and to avoid confusion, names of the parties of the particular case only will be shown in the cause title and the details of the deposits will be shown separately in the table.

          U/s.12 of the C.P. Act, complainant/s have filed the complaints against the O.Ps. alleging deficiency in service of non payment of the F.D.Rs. amount.

          2) In-spite of service of notice O.P.2 to 9 remained absent. Hence placed ex-parte.  Though the OP.1 appeared through his advocate but not filed objections, affidavit and also not argued the matter.

          3) In support of the claim in the complaint, complainant/s have filed their affidavit and original F.D.Rs are produced by the complainants.  

          4) We have heard the argument of the complainants counsel and perused the records.

          5) Now the point for our consideration is that whether the complainants have proved deficiency in service on the part of the O.P’s. and entitled to the reliefs sought?

          6) Our finding on the point is partly in affirmative, for the following reasons.

          7) On perusal contents of the complaints and affidavit filed by the complainants, for the future maintenance of education and marriage necessities the parents of complainants had invested money in OP society as detailed under:

        8) The complainants submit that, they have already attained majority and are entitled to the matured amount. The complainants are not members and unaware of events at society. The board of management is now under Chairmanship of OP-1, who along with other OPs has already sold the property of society and received amount but have failed to make payment of the amount to complainants. The OPs have even failed to renew the said FDs and provide the complainants interests against the said FDRs. The OPs have used the said amount in Deposit Account for advances among themselves and even though they have obtained awards and filed execution petitions and recovering money at the respective courts but have failed to make payments inspite of making several requests by the complainants. Therefore the complainants are constrained to file these complaints against OPs.

9) On perusal of the affidavit filed by the complainants the original FDRs produced by the complainants are in the names of complainants  & after maturity of the FDRs  inspite of the demands made the amount remained unpaid, has to be believed and accepted. Inspite of service of notice to OP-1 to 3, remained absent, Hence OP-1 to 3 have been placed exparte.  Hence it is well settled legal position that non payment of the amount deposited, amounts to deficiency in service.

          10) Taking in to consideration of various aspects and the decision of Hon’ble Apex Court reported in (2011) SCCR 268 and of the Hon’ble Apex Commission reported in 2013 (2) CPR 574 as well as other subsequent decisions absolutely it is just and necessary to impose cost on daily basis if order remains uncomplied within the period fixed for compliance of the order, so as to have feeling and pinch.

       11) Taking into consideration of the facts, evidence on record and the discussion made here before deficiency in service on the part of the O.Ps. have been proved.

       12) Accordingly the following

 

:ORDER:

          The complaints are partly allowed.

         The Opponents.1 to 8 as shown in the cause title are hereby jointly and severely directed and liable to pay the complainants as ordered below :

          The F.D.Rs. amount under column No.4 with agreed rate of interest mentioned at column no.7 respectively from 15.06.2010 till 15.03.2011 along with future interest @ 9% P.A. from 16.03.2011 till realization of the entire amount.

Further, Opponents. 1 to 8 as shown in the cause title are hereby jointly and severely directed and liable to pay a sum of Rs.3,000/- in each case to the complainant/s towards costs of the proceedings.

          If the order is not complied within stipulated period, O.Ps. are hereby directed and liable to pay a sum of Rs.50/- per day to the complainants from the date of disobedience of order, till the order is complied.

The order shall be complied within 30 days from the date of the order.

Original order be kept in Compt.377/2016 & its copy in other connected cases.
