             The Ld. Agent of the Complainant and the O.P. No.2 & 4 are present.

           The Complainant by filing a petition duly verified prays for an order for withdrawal of the complaint on the ground of suffering the same for some vital defects with the permission to re-file the same afresh on the self same of cause and reliefs on the ground stated therein.

           In course of hearing of the petition, the Ld. Agent of the O.Ps on record does not oppose the prayer. The Ld. Agent representing the Complainant drawing our attention of the materials on record particularly to the complaint submits that as certain materials defects could be engraved in the complaint, the complaint is essentially required to be withdrawn with a view to file the same afresh for reliefs.

         Having heard both sides and in the light of the materials on record and submission on both sides, we are of the view that the Complainant should be allowed to with from the complaint.

Accordingly,

                Ordered,

                                That the Complainant is allowed to withdraw from the complaint and thus the complaint be and the same is disposed of being withdrawn but in the circumstances without any cost with the liberty to the Complainant to file the same afresh, if not otherwise barred.
