The petitioner Mr. Sibaprasad Dey on 12.08.2022 has filed a petition with verification praying for passing an order to allow the petitioner to proceed with the case in place of deceased complainant on the grounds that the complainant Mrs. Mira Rani Dey has expired on 19.07.2022 and the applicant (petitioner) , being the son and only legal heir , wanted to be substituted , in place of the complainant Mrs. Mira Rani Dey . In support of his claim, he filed the death certificate regarding death of Mira Rani Dey, legal heir certificate dt. 01.09.2022 issued by the Executive Officer, Burdwan Municipality.
On perusal of those documents, it appears that the complainant Mrs. Mira Rani Dey has expired on 19.0-7.2022 and the applicant is the only legal heir and son of the said complainant. The petition has been filed on 12.08.2022 i.e. within the period of limitation. Accordingly, the prayer of the applicant (petitioner) is considered and allowed.
Let the name of the petitioner Mr. Sibaprasad Dey be substituted in place of the complainant Mrs. Mira Rani Dey since deceased of the complainant.
Amend the complaint and Register accordingly.
To 15.12.2022 for filing of the amended complaint by the complainant.
M.A. case being No. 62/2022 is thus disposed of.
Let a copy of this order be supplied to the parties on free of cost.
