Complainant is present. Since case is posted to today for ex-parte hearing, heard the ex-parte arguments advanced by the Complainant in person. Upon perusal of materials available on record and taking considerations to the submissions of Complainant what we noticed is that the Complainant did prefer the instant complaint seeking directions of this Forum to O.Ps for refund of an amount of Rs.16,000/- against Bank Draft No.485940 dated 21.07.2008 towards tuition fees as he could not take his admission into Satyasai Engineering College, Balasore due to his financial crisis though he was selected to take admission into the said Engineering College in 4 year BE/B Tech course in the year 2008 bearing Roll No.25313460 and a Rank of 585019 in AIEEE. Thereafter on repeated demands made by the Complainant-Poor Students for refund of his said Admission fees as per the provisions settled but O.Ps paid a deaf ear to same. Such acts & omissions on the part of the O.Ps certainly amounts to deficiency-in-service on their part. Since the claim of the Complainant gone unrebutted the complaint bears merit and hence the order.

                                                                                  O  R  D  E  R

                                     Having regards to our judgment reflected above the complaint is allowed with directions to O.Ps to go for refund of case Bank Draft amount of Rs.16,000/- along with interest @ 12% p.a from the date of deposit 21.07.08 till today which approximately comes to Rs.11,680/- till today and in to to Rs.27,680/- within one month from the date of communication of this order to Complainant.

                                     Delay in any manner shall carry Rs.100/- per day payable by O.Ps to Complainant along with awarded amount.

                                     In the circumstances of the case no order as to costs & compensation.
