The petition for substitution of the sole complainant of CC/17/2019 Lipika Panja has been pressed in this IA by her heir Arpita Panja Mitra praying for substituting the applicant of this IA Arpita Panja Mitra in place of deceased complainant of this CC/17/2019 Lipika Panja is taken up for hearing.
Heard Ld. Counsels for all the contesting parties.
The application for substitution filed by Arpita Panja Mitra U/order 22 Rule 3 of C.P. C. is taken up for hearing.
Perused the death certificate of Lipika Panja filed from the ned of the petition of this IA Arpita Panja Mitra from the said death certificate of Lipika Panja issued on 15.12.2023 by Baikunthapur Gram Panchayat II. It is appearing from the death certificate of previous complainant of CC/17/20189 i.e. Lipika Panja had she expired on 11.12.2023.
Considering the submission of both sides and having regard of this complaint case the instant petition of Arpita Panja Mitra seeking for substitution of her name as the applicant of CC/17/2019 in place of previous complainant Lipika Panja, since deceased, is allowed.
For the ends of justice, accordingly this IA is allowed.
Arpita Panja Mitra is allowed to be substituted complaint of CC/17/2019 as prayed for accordingly substituting complaint of CC/17/2019 Arpita Panja Mitra is directed to take appropriate steps by 27.08.2024 in respect of this CC/17/2019 for further proceedings.
