The complainant files hazira. Heard the submission made by the ld. Advocate on behalf of the complainant. Seen the complaint and documents filed on record.

The OP1, CMRI, does not carry on business at Purba Medinipur, nor it has any branch that personally works for gain at Kolkata.

Moreover, no cause of action against OP1, arose in this station at Purba Medinipur. There is no allegation and relief against the OP2, no cause of action against the OP2.

Relief is prayed for only against the OP1, (CMRI, Calcutta) for cause of action arose at Kolkata. So this District Forum at Purba Medinipur has no jurisdiction to entertain the instant complaint.

Therefore, it is ordered that the petition of complaint is rejected; i.e. the instant case is dismissed for want of jurisdiction. However, the complainant shall have the liberty to file fresh complaint before other Forum with proper jurisdiction to entertain such complaint, but within the limitation period as provided under the Provisions of C.P. Act, 1986.
