On perusal of the corresponding CC case records, instant MA case records and all other relevant aspects, it transpires that there is a prima facie case in favour of the Complainant.
Allegedly, the applicant of this MA case (complainant of the CC case), an account holder of the OP bank was granted a loan of Rs.7,35,925/- by the OP bank consequent upon simply an audio call and video call made to the Complainant account holder.
Reportedly, immediately after sanction of the loan, an amount of Rs.4,93,500/- had been debited and transferred to an unknown bank account.
Balance of convenience and inconvenience appears to be in favour of the Complainant.
The Commission is of the opinion that there is apparent urgency for passing an ad-interim order, otherwise the main purpose of passing the order in the instant MA case would be defeated by delay and the applicant is supposed to suffer irreparable loss.
In view of the above and on consideration of nature and character of the case and concentrating on the facts and circumstances of the case, this District Commission opines that at this stage an order of maintaining status quo by both the sides should be maintained in respect of all proceedings and transactions related to the alleged loan account in the name of the applicant involving an amount of Rs.7,35,925/-, payment of EMI thereof and providing default information to different credit information institutions such as CIBIL.
For this reason the interest of both parties should not be affected in any way.
So both the parties are directed to maintain status quo so far as further proceedings and transactions related to the alleged loan A/c and providing default information to different credit information Bureaus are concerned.
In the light of the observations made hereinabove the instant MA case is disposed of accordingly.
