(This Consumer Complaint  was remanded by the Hon'ble State Commission, Puducherry for disposal on merits as per order passed in F.A. No.20 / 2016 dated 10.11.2016 filed by the OP1/ Appellant against the order of the Consumer Complaint in C.C. No.30/2015 by this Forum by order dated 08.10.2015).

This is a complaint filed by the complainant under Section 12 of the Consumer Protection Act, 1986 praying to:

1. Direct the opposite parties to pay to the complainant the loss of amount of Rs.30,000/-, the value of the mobile phone with interest; or

To cure the repair of the mobile phone free from defect with subsequent period of one year warranty; or

To replace the mobile phone with similar description which is free from defect with subsequent period of one year warranty

2. Direct the Opposite Parties to pay the complainant Rs.60,000/- for mental agony
3. Direct the Opposite parties to pay to the complainant Rs.10,000/- for costs of the complaint and other reliefs.

            2. Today this complaint was called.  Complainant and Opposite Parties and Counsel for Opposite Parties, Counsel for complainant present and filed joint compromise memo stating that the above matter is settled and prays to dismiss the complaint.  In view of the memo, this complaint is hereby dismissed as not pressed.  The memo shall form  part and parcel of this order.
