            We perused the affidavit and documents placed on record by the opposite parties. We heard in detail the arguments advanced by the opposite parties’ counsel.   The counsel for the opposite parties submitted that the complainant/petitioner has approached this Forum suppressing the material particulars as to the proceedings already initiated against the complainant/petitioner under SARFAESI Act. On going through the materials produced before us by the opposite parties, it is manifestly unfolded that the proceedings under SARFAESI Act was pending against the complainant/petitioner at the time of filing the material complaint. In the view of the aforesaid finding, we are of the firm view that the instant complaint is not maintainable. With the result, the interim order already passed stands vacated.  
The complaint stands dismissed.
