The case is fixed for argument.
After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -
The Complainant’s case is that She has a Group Insurance Policy namely United Surakshya Yojona at the instance of O.P. No.2 linked to her S.B. A/c No.0525010219532 with O.P. No.1 and has been paying yearly premium of Rs.17/- as per standing instruction. On 31/12/2015 she met with a road accident with severe badly injury and bony fracture for which she was hospitalized for a prolong period in different hospital and for the purpose of such treatment the Complainant had to incur Rs.63,415/-. As a result of such accident she suffered permanent disability and Disability Certificate to the extent of 55% No. being 49, dt.31/12/2015 has been issued by the competent authority. But the O.P. No.2/Insurance Co. has refused the settlement claim on the ground that the Policy was not valid at the time of accident as it is expired earlier. The Complainant has therefore approached this Commission for appropriate relief.
O.P. No.1/PNB has not filed any written version to contest the case. O.P. No.2/Insurance Co. has filed a written version reiterating the same.

. -: Decision with reasons: -
Having regard to the facts of the case, submission, contention and documents on both sides the Commission finds that from the Bank statement produced by the Complainant deposit of yearly premium of Rs.17/- could not be found for the Year-2015 whereas deposit of yearly premium for the Year-2014, 2016 & 2019 is found with the Bank statement. It is no doubt true that such type of Policy stands renewed from year to year on auto debit process as per standing instruction but in this case it may be an administrative fault on the part of the O.P. No.1 Bank to deposit the yearly premium of the Policy with the O.P. No.2/ Insurance Co. from year to year and lapse of premium for the Year-2015 is attributable to that factor.
But the Group Insurance Policy like United Surakshya Yojona covers Accidental death and permanent total disability like loss of eye and loss of hand and feet. In this case Disability Certificate to the extent of 55% issued in favour of the Complainant does not entitle her to get the Insurance claim on permanent disability ground. No other material is on record to justify permanent disability of the Complainant. Even if O.P. No.1/Bank may be liable to continue the Policy from year to year by deposit of yearly premium of Rs.17/- to O.P. No.2 but the terms and condition of the Policy in such case does not favour the Complainant to get the Insurance claim as prayed for.
Hence, it is ordered………..
That the case be and the same is dismissed on contest but without cost.
Both parties be supplied copy of this order free of cost.
