No. 1/13.04.2009.

SRI A. K. RAY, MEMBER.

Appellant is present in person.  The appeal is directed against the final order dated 29.02.2009 passed by the District Forum, Howrah in Complaint Case No. 93 of 2008 wherein the Forum below dismissed the complaint on contest without cost.  we have gone through the memo of appeal, the impugned judgement and other papers furnished by the Appellant along with his memo of appeal.  We do not find any infirmity or illegality in the order impugned.  Evidently the Appellant took a loan from the UBI under Prime Minister’s Rozgar Yojana self-employment scheme against which a loan of Rs. 54,000/- was sanctioned to him by the said Bank.  Subsequently the Appellant failed to prove that he was able to run his business properly.  The O.P. – Bank conducted a spot enquiry and came to the finding that no raw materials/finished goods were there in the shop of the Appellant and an FIR was subsequently lodged by the said Bank on 10.07.2003 against the Appellant.  We have also perused the letter dated 18.07.2003 from the Appellant to the Branch Manager of UBI, Ramrajatala Branch.  On that date i.e. 18.07.2003 he deposited an amount of Rs. 5,000/- and prayed to the Bank for allowing him to deposit further sum of Rs. 8,585/- without interest within six months.  As understood from the verbal submissions of the Appellant he thereafter did not try to make payment of his dues to the Bank.  It was a sheer failure on his part.  We are constrained to reject his appeal petition which stands dismissed without being admitted.
