Final Order / Judgement

This is a case for claim and Compensation

The Complainant’s case in short is that the Complainant deposited Rs. 30,000/- with the OP vide Certificate No. 2028, Receipt No. 30 A/C No. 284 issued on 09.08.2002 for a period of two years whose maturity value was Rs. 35,493/-. Thereafter, the Complainant deposited a sum of Rs. 30,000/- with the OP on 11.04.2003 vide Certificate NO. 2064 Receipt No. 21 A/C No. 319 whose maturity value was Rs. 35,493/-, matured on 11.04.2005. As the OP did not pay any amount upon maturity of the same, the Complainant filed this case for an order to the OP to pay the total maturity value of Rs. 70,986/- along with interest Rs. 3,000/- and litigation cost as well as compensation.

                The OP has neither paid cost imposed by the Forum for vacating the order for exparte hearing nor the order for exparte hearing is vacated. So the case is taken up for exparte hearing.

                Heard the Complainant and perused the documents Ext. 1 and Ext. 2 i.e. certificate for Rs. 60,000/- we find that the Complainant paid Rs. 60,000/- to the Society for which he is entitled the amount with matured value totaling Rs. 70,986/- which can not be denied at this stage as the case is heard exparte. Under the circumstances we allow the petition or the Complainant.

Hence

That the case be and the same is allowed ex-parte against the OP. The Complainant is entitled to have Rs. 70,956/- along with 8% interest P.A. over the amount Rs. 35,493/- from 09.08.2004 and over the amount Rs. 35,493/- from 11.04.2005 respectively along with litigation cost Rs. 1,000/- from the OP> The OP is directed to pay the same by one month from the date of this Order failing which the Complainant is at liberty to execute the order through this Forum after expiry of the period mentioned above.
