Shri S. K. Ojha, Sr. Member : - The brief facts of the complainant’s case is that, he has purchased one Tata LPT-2518-TC bearing Regn. No.OR-23E-7477 which has been financed by the O.Ps for an amount of Rs.13,95,000/- only Which the complainant was liable to pay the loan amount with interest in 47nos. of installments for amount of Rs.38,900/- only permonth started from dtd. 12.09.2011 to 10.08.2015. The complainant has paid Rs.12,11,611/- only and cleared 32 nos. of EMIs, but due to his illness of viral hepatitis and jaundice from dtd. 11.08.2014 to 12.10.2014 he could not paid some of the installments in time but the O.P is demanding Rs.3,44,389/- only illegally and threatening to seize the vehicle without supplying the correct statement of accounts, hence this case.
The O.Ps. appeared through their counsel after being noticed and submitted his written version wherein it has been stated that the complainant is a defaulter in making payments of installments. The O.P further submitted that the complainant has taken loan to purchase a Tata LPT 2518 vehicle who had outstanding dues of Rs.5,07,955/- only in total till the date of filing of written version and with denying all the allegations imposed by the complainant, the O.P has prayed for dismissal of the case.
Heard and perused the case record along with materials available.
The complainant filed a medical certificate dtd. 12.10.2014 issued by Dr. Braja Kishore Bhoi, Medical Officer, IC Rajpur CHC, District Jharsuguda regarding the illness of complainant from viral hepatitis and jaundice from dtd. 11.08.2014 to 12.10.2014. The complainant also filed one statement of accounts dtd. 12.01.2015 which reflects installment overdue of Rs.3,44,389/- only and other overdue of Rs.1,66,509/- only.
The complainant prayed before this forum and seeks some reliefs for not to seize the vehicle where this Hon’ble Forum provided relief on the same in the form of Interim Order. The O.Ps. failed to file any accounts statement regarding the actual dues till date.
However, it is the matter of finance, the complainant should pay the EMIs in time but due to his illness he could not paid few installments in time. After observing the facts and circumstances, the complainant should give a chance to repay the same.
Hence, we allow the complaint petition partly with directions to the O.Ps to issue afresh correct statement of outstanding dues to the complainant and receive as the same from the complainant.
Accordingly the case is disposed of.
Order pronounced in the open court today the 13th day of July’ 2015 and copy of this order shall be supplied to the parties as per rule.
