The consumer complaint Case No. 4 of 2015 filed by the Complainant Smt. Khwairakpam Ongbi Memsana Devi U/S 12 of the Consumer Protection Act , 1986 for deficiency of service on the part of respondents.
The case of the complainant in brief is that, the husband of the complainant namely Shri Khwairakpam Chaoba . Singh who was an employee of NHPC bought 5(five) Insurance PolicIes being No.i) 49288404, ii) 492884703, iii) 490037423, iv) 490950707, and v) 492838992 respectively under the salary saving scheme of Life Insurance Coporation of India,Churachandpur Branch.
The name of the complainant is recorded as nominee in the said life Insurance Policies .he holder of the said Life Insurane Policies died on 20/08/2009. On the death of the said policies holder ,the complainant being a nominee made a death claim to the opposite party. The opposite party refuse the death claim made by the complainant stating that the policies holder Kh. Chaoba Singh was died due to assault by the complainant and her son and further stated that the death claim shall be considered after the disposl of the FIR Case No. 92(8) by the concerned court.
On 07/03 2014. The Chief Judicial Magistrate ,Bishnupur passed an order therby accepting the FINAL REPORT submitted by the I.O. of the case.Again a complaint case being Complaint Case No. 2 of 2009 was also filed before the Court of Chief Judicial Magistrate,Bishnupur by one Khwairakpam .Naba Singh,the younger brother of the deceased but the said complaint Case was also disposed of on 13/06/2014 by the Chief Judicial Magistrate .Bishnupur as the matter is co- related with the FIR which was already accepted Final Report but the opposite party refused to pay the death claim till death.
Hence , the present consumer complaint case.
The opposite parties are also present and contested the case therby filling their written statement
Heard the arguments of both the parties at length and also examined the documents produced by both the parties minutely.
The complainant claims the opposite parties to make payments in respect of 5(five) Life Insurance Policies to the present complainant being the nominee of the said deceased person in the said Life Insurance Policies.The opposite also admitted that the complainant being the nominee of the policy holder had submitted death claim to the opposite party.Further the opposite party has submitted that they are ready to pay he death claim if the informant/ complainant of the FIR Case being No.92(8)2009 and Cril.Complaint Case case No.2 of 2009 of the court of chief judicial magistrate,bishnupur have no objection to pay the said death claim amount to the present complainant ,R.K.Ningol Khwairakpam ongbi Memsana Devi.Accordingly, this forum summoned the said informant/complainant Shri.Khwairakpam Naba Singh ,the younger brother of the deceased ,policy holder to give evidence before this forum as witness and to record his statement.On 05/08/2016 ,the said Kh.Naba Singh was examined and deposed that he has no any objection to received the death claim amount by the nominee of the deceased Kh.Chaoba Singh.
On perusal of the materials placed before us we are ascertained that the deceased Kh Chaoba Singh bought 5(five) Life Insurance Policies Bearing No.492884014,492884703,490037423,490950707 and 492838992 respectively and the present complainant is also the nominee of the said policy holder .
In the result ,we came to the conclusion that ther is no negligence and the deficiency of services on the part of the opposite parties.But no doubt there is no any dispute between the parties regarding the claims of the complainant.
Therefore , we direct the opposite parties,Life Insurance Corporation of India to pay the payable amount of the said 5(five) Life Insunce Policies to the present complaint Smt.R.K.Ningol Khwairakpam Ongbi Memsana devi along with the cost of ligitataton of a sum of Rs.10,000/- within 4(four) weeks from the date of the order.
