                                      Complainant  is  absent. No step taken on his behalf to proceed with the case. Perused the complainant petition . Late Brundabana  Merli  is the purchases  of the Tractor with the financial assistance of the O.P. Hence in the absence of legal heir  certificate, death certificate  and terms and conditions of the loan agreement it is not possible to know whether the present complainant is a consumer or not.                                                                                  

            Further  there is no legal bar for the financer to seized the tractor when there is default in making repayment of the loan amount. Hence there is no primafacei  case of deficiency in service on the part of the O.P.

                             Accordingly the case is dismissed as not admitted.

          Pronounced in the open Forum  to-day  i.e the  11^th  day of   March ’  2020.
