Case record taken up today for hearing and settlement of dispute.

Parties are absent on call. However in view of Sec 38(3)(c ) of C.P Act 2019  we proceed to decide the complaint on merits.

Perused the material available on record and gone through the previous orders . It is found that, on 15.07.2022 learned counsel for the parities were present. The authorized representative i.e. power of attorney holder of the O.P No.1 being identified by their learned counsel Sri Rupesh Kumar Hota submitted that, the matter has already been settled as such they do not want to file their written version upon which this Commission has directed him to file  their affidavit regarding settlement of dispute.

It is found that, there was no quorum on the date fixed i.e. 20.07.2022 however the authorized representative / Power of Attorney holder of O.P no.1 namely Abhisekh Mohanty S/O Sunil Kumar Mohanty residing in front of Town Hall,Bhawanipatna, Po/Ps Bhawanipatna,Dist-Kalahandi filed an affidavit stating therein at complainant  has already settle  his dispute with the O.P /Company therein in this C.C  Case No.118 of 2020 outside of the Commission as such does not want to proceed further in this case. Said affidavit filed by the O.P No.1 on 20.07.2022 is taken in to the record. No objection thereon if filed by the complainant. 

In view of the above said amicable settlement of the parties this Consumer Complaint is disposed off. Parties to bear their own cost.  Free copy of this order be supplied to the respective parties or they may download the same from the Confonet as copy of the order receipt from this Commission.
