        Complainant, petitioner herein, raised a dispute before the District Forum regarding the rate of interest as also the amount of FDR adjusted towards loan taken by the petitioner from the respondent Bank.  The District Forum dismissed the complaint seeking compensation.  Aggrieved against this, petitioner filed an appeal before the State Commission.  It was stated by the State Commission that the respondent Bank had filed a civil suit against the petitioner who had taken the loan, in which written statement has been filed.  Keeping in view that the dispute is already pending before the Civil Court, the State Commission dismissed the appeal leaving it open to the petitioner to either file a fresh suit against the respondent or to project his defence before the Civil Court.

 

        We find no infirmity in the order passed by the State Commission.  Under the circumstances, only civil court can decide the dispute.  Dismissed.
