JUDGEMENT

Mr. Purna Chandra Mishra, President.

          Complainant Jayanti Digal has filed this case u/s 35 of the CP Act-2019 alleging deficiency of service and unfair trade practice on the part of the Opposite Party for non-payment of insurance claim in respect of her deceased husband and praying therein for direction to the Opposite Party to pay the insured amount of Rs.  2,00000/- without further delay.

  1. Brief fact leading to the case is that the husband of the complainant namely Kambhupani Digal had insured his life under Prime Minister’s Jeevan Jyoti Yojana and deceased Kambhupani was paying his premium of Rs. 330/- per year from 2018 onwards. On 30.01.2021, the husband of the complainant died during the course of treatment and after his death, the OP Bank played hide and seek to pay the death claim of her husband, for which she filed this case for the reliefs as discussed above.
  2. After receipt of notice, the Opposite Party appeared in person and before filing written statement submitted in the Commission that the Insurance of the deceased was valid on the date of death and he promised before the Commission in writing that he will settle the claim amount within 3 months which ends on 04.07.2023. As the Opposite Party admitted to pay the insurance amount in respect of Kambhupani Digal by 04.07.2023, we do not want to go further into the case and hence the order.

 

O R D E R

          The complaint petition is disposed of with a direction to the Opposite Party to pay the insured amount of Rs. 2,00,000/- (two lakhs)only within 04.07.2022. If the Opposite Party fails to pay the amount as directed within the stipulated period, the amount will carry interest @ 12% per annum from the date of claim till it is actually paid to the complainant.
