Complainant files hazira. Op no. 2 files hazira. Complainant files a petition praying for dropping of the instant case on the ground stated therein. On behalf of op no. 2 one petition is filed intimating about the total development in between the parties.

The petition filed on behalf of op no. 1 stands rejected being “not pressed” by the ld. Advocate of op no. 1.

Heard the ld. Advocates appearing for the parties at length.

Perused the materials on record. It appears that compliant in his petition has specifically narrated that A.C. machine in question has been replaced and he has received a cheque, whereas op no. 2 in his petition has mentioned that towards litigation fees of Rs. 5000/- has been provided to complainant.

Going through the materials on record it may be noted that when complainant specifically mentioned that he does not want to continue the case further more and as such there is no need to proceed further and thus, the instant case is dropped and filed.
