Opposite party No.1 agreed in Ex.B10 that the staff of opposite party No.2 Bank intimated to him that they sent DD. But opposite party No.1 did not enquire into the matter till the complaint issued legal notice to both the opposite parties on 17-06-2011. The above facts are clearly discloses that the DD sent by opposite party no.2 was misplaced at opposite party no.1 Bank only and the amount is not credited to the complainant’s account till date, because, opposite party No.2 Bank returned duplicate DD by mentioning “20. Duplicate DD should be paid across the counter”, This delay was caused only, due to the negligent acts of the opposite party no.1 Bank , and there was no delay or deficiency of service on the part of opposite party no.2 in realizing the cheque in question and made payment by way of DD on 20-09-2010 within 20 days after it was placed before opposite party No.1 for collection. This complaint has to be allowed against opposite party No.1 and has to be dismissed against opposite party No.2
