This is a complaint made by the petitioner Manas kumar Das against the Branch Manager and Directors of Alchemist Infra Reality Ltd. praying for a direction upon the OPs to return the deposited amount of Rs. ,100,000/- deposited with the OP no 2 through the OP No.1 from 02.12.14 along with interest @10% till realization and compensation for a sum of Rs.1,00,000/- and litigation cost of Rs.10,000/-.

In short, case of the Complainant, is that he invested a sum of Rs.50,000/- on 02.06.2019 at a time to the OP -2  through OP No.1 being certificate No. as mentioned in the petition of complaint.  The OPs returned the maturity value by issuing a cheque  on 02.06.15 but the said cheque bounced for insufficient fund.  The maturity value was Rs. 1,00,000/- and the maturity date was 02.12.14. The complainant again demanded the amount and the OPs issued one cheque for Rs 1,04,000/- but it also bounced.

Hence, this case.

In spite of service of notice upon the Opposite parties, none has appeared to contest the case. Hence, the case is heard ex parte against the OPs.

Point to be considered in this case is whether or not the Complainant is entitled to the relief(s) sought for by him.

Decision with reasons

We have carefully perused the affidavit of the complainant and all the documents filed by the complainant and we are of the opinion that the complainants have been able to prove their claim against the OPs. and he is entitled to get the reliefs as prayed for.

This complaint case, thus, succeeds.

Hence,

O R D E R E D

That CC/98/2017 be and the same is allowed ex parte against the OPs.  

The OPs are directed to pay the complainant a sum of Rs.1,00,000/- within one month from the date of this order for ends of justice, in default, OPs will have to pay interest at the rate of 10% p.a. from the date of maturity till final payment. OPs are further directed to pay compensation of Rs.1000/- and Rs.1000/- as litigation cost to the complainant within one month from the date of this order, failing which OPs will be liable to pay Rs.100/- daily as punitive charges which will be payable to the Consumer Welfare Fund.

Let the copies of the judgement be supplied to all the parties free of cost.
