The case of the complainant that she invested Rs 1,10,000/- at a time for MIS to the Opposite party on 24.12.2011 for three years being certificate No. RXX0Q57059. The date of maturity of said MIS was 24.12.2011. The OP has given the monthly returns to the complainant regularly. The complainant demanded the principle deposit of Rs. 1,10,000/- from the OP on 20.12.14 by depositing all the relevant documents but the OP did not pay that amount The Op issued a cheque being No. 368053 to the complainant on 24.06.15 for a sum of Rs. 1,10,000/- but the said cheque had been dishonoured.
Hence, the claimant has filed the instant case with the prayer for reliefs as made in the claim petition.
In spite of due service of notice upon the OPs none of the Opposite parties has appeared to contest the case.
So, the instant case has been heard ex parte.
The points for consideration is whether the complainant is entitled to the reliefs as prayed for.
Decision with reasons
We have perused the all the documents in record.
Ld lawyer for the complainant submitted that the documentary evidence furnished by them will amply prove the case of the petition.
Perused the documents submitted by the ld advocate for the complainant and we are of the view that the complainant has proved her case ex parte and is entitled to get the reliefs as prayed for.
Hence, it is
O R D E R E D
That the complaint case being No.337 of 2016 be and the same is allowed against the ex parte against the OPs.
The OPs are directed to pay Rs. 1,10,000/- to the complainant within four months from the date of this order failing which the OPs will have to pay interest at the rate of 10% per annum from the date of filing of the complaint till final payment. OPs are further directed to pay compensation of Rs.10,000/- and Rs.3000/- as litigation cost to the complainant within four months from the date of this order, in default, the OPs will be liable to pay Rs.100/- daily as punitive charges which will be payable to the Consumer Welfare Fund.
Let the copies of the judgement be supplied to all the parties free of cost.
