Final Order / Judgement

SMT. SYEDA SHAHNUR ALI, MEMBER

This is a complaint made by one Dipika Bose against the Branch Manager and Directors of Alchemist Township India Limited, praying for a direction upon the OPs to return the maturity value of Rs. 120000/- along with interest @ 10% from 01.04.2016 till realization, and compensation for a sum of Rs.100000/- and litigation cost of Rs.10000/-.

In short, case of the Complainant, is that, she invested Rs. 120000/- as MIS to the OP no. 2 through OP no.1 on 31.03.2016 for two years being certificate no. TB00209537. The OPs have given the monthly returns to the complainant. The date of maturity was on 31.03.2016. That on the date of maturity, the OPs pressurised the complainant to reinvest the said amount and the complainant reinvested the same and the maturity date is on 30.09.2018. That since April 2016, the OPs did not pay any monthly return to the complainant and hence the complainant demanded the invested amount from the OPs but the OPs did not pay the same. Under the circumstances the complainant has filed this case for the reliefs as prayed for in the petition of complaint.

None of the OPs appeared to contest the case in spite of receiving summons so the case is heard ex-parte against OPs.

Point to be considered in this case is whether or not the Complainant is entitled to the relief(s) sought for by her.

Decision with reasons

We have carefully perused the affidavit of the complainant and all the documents filed by the complainant.

After consulting the uncontroverted documents of the complainant we have no hesitation to hold that the complainant is entitled get relief, as prayed for.

This complaint case, thus, succeeds.

Hence,

O R D E R E D

That CC/22/2017 be and the same is allowed ex parte against the OPs.

OPs are directed to pay Rs. 120000/- to the complainant within four months from the date of this order for ends of justice, in default, OPs will have to pay interest at the rate of 10% p.a. till final payment. OPs are further directed to pay compensation of Rs.3000/- and Rs.1000/- as litigation cost to the complainant within four months from the date of this order, failing which OPs will be liable to pay Rs.100/- daily as punitive charges which will be payable to the Consumer Welfare Fund.

Let the copies of the judgement be supplied to all the parties free of cost.
