The instant complaint has been filed by the complainant u/s 12 of C. P. Act, 1986 praying for a direction upon the OP to grant easy monthly installments and to pay Rs.20,000/- towards compensation and Rs.1000/- towards cost.

The complainant’s case, in brief, is that the complainant carries on stationary business and for that the complainant took a Term Loan for a sum of Rs.50, 000/- in the year 2000 in P.R.M.Y Scheme. As per demand of the OP the complainant paid Rs.6, 000/- on 19.09.2012. Thereafter, the complainant paid Rs.7, 5000/- to the OP on different dates. Thereafter, the OP threatened the complainant to pay Rs.4, 700/- on and before 31.07.2013 otherwise the account will be declared as N.P.A on 03.08.2013. The demand of OP is baseless and the complainant files this complaint for easy installments.

The OP has filed the written version denying all the allegations of the complainant. The case of the OP is that the complainant applied for a Loan from the Bank and the said loan was sanctioned in the year 2000. The complaint was not regular in payment of Loan amount with interest. This OP served notice to the complainant requesting him to pay Rs.4, 007 within 31.07.2013. There notice is not illegal. There was no deficiency of service on the part of the Opposite party. 

The instant case was filed on 01.08.2013 and since then the complainant has filed the evidence-on-affidavit. Now the ld. lawyer for the complainant has filed a petition for dismissal of the case for non-prosecution as the complainant is not willing to proceed with the case further.

Considering the present prayer and the above facts and circumstances of the case we are of view that this Forum has no other alternative but to dismiss the case.

Hence,

                                                 Ordered

that the Consumer Complaint No. 96/2013 be and the same is dismissed for non-prosecution.

 

Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
