The instant complaint has been filed by the complainant u/s 12 of C.P. Act, 1986  praying for direction upon the OP to furnish the loan clearance certificate, for harassment cost of Rs.50,000/-and for compensation of Rs.50,000/-.

The complaint, in brief, is that the complainant, a fisherman, took a loan for Rs.1400000/- from the OP. But due to losses in his fishery business, he failed to pay the EMI’s and the loan account became NPA. After negotiation with the OP Bank, the complainant paid Rs. 9,50,000/- as full and final settlement of the outstanding dues of the loan on 14.02.14 but the OP Bank refused to return the original documents alongwith the loan clearance certificate and as such the complainant is compelled to file this case.                   Hence, the instant complaint.

The complainant appeared before the Forum personally and submits that the dispute between the parties has been settled on compromise. He has also submitted that he is not willing to proceed with the case further and has prayed for withdrawal of the case.

Considering the submission of the complainant as well as the petition filed by the complainant, we are of the view that the case be disposed of being withdrawn.

 Hence,

ORDERED

that the consumer complaint No. CC/162/2014 be and the same is disposed of being withdrawn.

 Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
